Gregory Allen Moyer appeared in Circuit Court on November 5 in connection with a charge that he violated his probation. It turns out that the case has a lengthy history. According to the court file, Moyer was charged in 14 indictments with taking indecent liberties with a minor on various dates in 2001. The offense involved exposure of his genitals and encouraging the minor to do the same.
The indictments were returned on April 26, 2004. He fled the jurisdiction and was eventually apprehended in Texas. He was returned to Fluvanna County and was convicted and sentenced to an active sentence of three years and six months to be followed by 10 years of supervised probation.
After Moyer's release, he performed various acts of community service. However, he failed to register as a violent sex offender. He was arrested and charged in Charlottesville with failing to register. After a guilty plea to that offense on October 21, he was sentenced to a three year suspended sentence with six months of GPS supervision. He was remanded to custody because he was on probation in Fluvanna County and the guilty plea constituted a violation of his probation. The hearing on the alleged violation is scheduled for December 3. Moyer will remain in custody pending the outcome of that hearing.
Pascall Craig Banks, one of the defendants indicted on October 26, had his trial scheduled for January 8, 2010. Banks entered a not guilty plea to a charge that he operated a motor vehicle while his driving privileges were suspended as the result of having been adjudicated a habitual offender. He remains in custody.
James Anthony Little, indicted on October 26 with forging and cashing three checks which he had stolen from another, entered a plea of not guilty. His non-jury trial is scheduled for January 22, 2010. He will remain in custody pending the outcome of the trial.
The charge of attempted armed burglary of a dwelling was amended at the time of arraignment of Denika Johnay Page. The charge now carries a minimum prison sentence of five years with a potential maximum sentence of life in prison. A non-jury is scheduled for January 28, 2010. Page remains free on bail.
A Kents Store man was remanded to the custody of the Department of Corrections for evaluation to determine suitability and eligibility to participate in a diversion center incarceration program. The program is intended as an intense form of probation designed to assist the defendant in becoming a productive member of the community. Lamar Reuben Ragland will be sentenced for probation violation on December 30 after the Department of Correction evaluation of his eligibility for the program is reviewed by the court.
Carl Leroy Wade entered not guilty pleas to two indictments alleging breaking and entering a dwelling with the intention to commit and the use of a firearm in the commission of a felony. At the arraignment the Assistant County Attorney sought an amendment of the indictments that could expose Wade to a term of life in prison. He is exposed to a minimum prison sentence of five years.
The arraignment of a Palmyra man on 11 felony indictments including alleged gang activity was postponed until December 10. The bail bond of Paul A. McClure was continued.
