Robert and Jeanette Patrick, owners of Bagelicious Bagels in Palmyra, have been charged with grand larceny in two separate indictments.
Robert Patrick entered a guilty plea, admitting that he stole merchandise from Sam's Club on June 16, 2009. A plea agreement that underlies the guilty plea leaves sentencing up to the judge who presides over the sentencing.
The plea agreement states that the Commonwealth will not indict Patrick for "additional incidents between April 22 and June 16 that were" investigated by Sam's Club. He is scheduled to be sentenced in Albemarle Circuit Court on December 9th. According to the plea agreement, Patrick must make restitution in the sum of $1,350.00.
One week before Patrick's sentence, his wife is scheduled to be tried on an indictment charging her with grand larceny. The crime is alleged to have occurred on May 5, 2009.
The underlying complaint alleges that Jeanette and her husband were observed on video using two shopping carts. The merchandise in one cart was "prescanned." The pair left the store with two carts containing merchandise. However they only paid for the items in the cart that had been prescanned. The value of the items in the second cart is alleged to be $357.51.
The non-jury trial of Jeanette Patrick will be held at 4p/m. on December 2.
